Disclaimer

The testing results, reports, and data provided by Microlab Testing Private Limited (“Microlab Testing,” “the Company,” “we,” or “us”) are based on samples submitted by the client and tested under the conditions specified in the applicable test methods and standards. All results pertain solely to the samples as received and tested.

Advisory Nature of Results

Test results and reports issued by Microlab Testing are advisory in nature and are intended to assist clients in making informed engineering and quality decisions. They should not be used as the sole basis for design decisions, material selection, or fitness-for-service determinations without independent verification by a qualified engineer or domain expert.

Limitations of Testing

Testing is performed on representative samples provided by the client. Microlab Testing does not warrant that the test results are representative of the entire lot, batch, or production run from which the sample was drawn. The Company is not responsible for sampling procedures unless expressly agreed upon in writing.

No Warranty

Microlab Testing makes no warranties, express or implied, regarding the merchantability or fitness for a particular purpose of any material or product tested. The Company does not certify, approve, or endorse any product, material, or process. Test reports reflect measured values under stated conditions and do not constitute a guarantee of performance in service.

Terms of Service

1. Scope of Services

Microlab Testing provides materials testing, analysis, calibration, and related laboratory services as agreed upon with the client. The scope of each engagement is defined by the test request, purchase order, or written agreement between the client and Microlab Testing. Services are performed in accordance with the test methods and standards specified in the scope of ISO/IEC 17025:2017 accreditation or as otherwise agreed in writing.

2. Report Ownership and Use

Test reports are issued to the client named on the test request. Reports remain the intellectual property of Microlab Testing Private Limited. Clients may use reports for their intended purpose but shall not reproduce reports in part without prior written consent. Any partial reproduction or selective quotation of test results is prohibited unless authorised by the Company.

3. Sample Handling and Retention

Samples submitted for testing will be handled with reasonable care. However, testing by its nature may be destructive, and samples may be consumed, altered, or rendered unusable during the testing process. Untested portions or remnants of samples will be retained for a period of thirty (30) days after report issuance unless otherwise agreed. After this period, samples may be disposed of without further notice. Clients requiring sample return must notify Microlab Testing in writing at the time of sample submission.

4. Limitation of Liability

The total liability of Microlab Testing Private Limited for any claim arising from or related to its services shall not exceed the fee paid by the client for the specific test or service giving rise to the claim. In no event shall the Company be liable for indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of production, loss of profit, loss of business opportunity, or cost of replacement materials, regardless of whether such damages were foreseeable.

5. Payment Terms

Testing fees are as quoted or as per the prevailing rate schedule. Payment is due within the terms specified on the invoice. Microlab Testing reserves the right to withhold reports and retain samples until full payment has been received. Taxes and duties applicable under Indian law shall be borne by the client.

6. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising from or in connection with these terms or the services provided by Microlab Testing shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.

3. Data Retention

Test records, reports, and associated client data are retained in accordance with our quality management system and ISO/IEC 17025:2017 accreditation requirements. Typically, records are retained for a minimum of five (5) years from the date of report issuance. Website usage data is retained for a period of twelve (12) months. Clients may request deletion of their personal contact information by writing to us at the address provided on our Contact page.

4. Data Sharing

Microlab Testing does not sell, trade, or rent personal information to third parties. We do not share client data or test results with any third party unless:

  • Expressly authorised by the client in writing.
  • Required by law, regulation, or order of a competent court or regulatory authority.
